Terms of Use (EULA)

These Terms of Use ("Terms") govern your use of the Apex Era mobile application (the "App"), provided by samko labs, s. r. o., with registered seat at Trnková 451/12, 040 14 Košice – mestská časť Košická Nová Ves, Slovak Republic (company ID / IČO: 53928881, VAT / DIČ: 2121532600) ("we", "us", "our"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The service

Apex Era lets you submit a photo of yourself and generate AI-restyled portraits of that photo in a chosen era or aesthetic (for example 1980s neon, 1990s grunge, Y2K). The App is for personal entertainment and creative use only.

2. AI-generated images

Every image the App produces is synthetic: it is generated by an AI model and is not a photograph of a real moment, a real outfit, or a real place. Results are unpredictable and may be inaccurate, unflattering, or fail to resemble you. You must not present generated images as authentic photographs, use them to impersonate anyone, or use them in any way that deceives others about who or what they depict.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the App. You are responsible for the accuracy of the images you submit and confirm you have the right to submit them.

4. Subscriptions, billing and free trial

Apex Era offers auto-renewable subscriptions, including a weekly plan (apexface.pro.weekly) that may include a 3-day free trial, and a yearly plan (apexface.pro.yearly). A subscription includes a recurring allowance of generation credits, refreshed each allowance period. Unused allowance credits do not carry over.
You may also buy credit packs as one-time, non-refundable in-app purchases. Purchased credits do not expire and are consumed only after your included allowance is used up. Credits have no cash value, cannot be transferred or exchanged, and are forfeited if your account is terminated for a breach of these Terms.
One credit is consumed per successful generation. If a generation fails, or the model declines your photo, the credit is returned to your balance automatically.
Prices are shown in the App and on the App Store in your local currency before you purchase.
Payment is charged to your Apple ID account at confirmation of purchase.
The subscription automatically renews for the same period at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period.
If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
You can manage or cancel your subscription, and turn off auto-renewal, in your device Settings → Apple ID → Subscriptions. Deleting the App does not cancel your subscription.
Purchases are processed by Apple and are subject to the Apple Media Services Terms and Conditions. Refunds are handled by Apple.

5. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the App Store Terms of Service. You may not copy, modify, reverse-engineer, or resell the App.

6. Acceptable use

You agree to submit only photos of yourself, or photos of another adult who has given you their explicit permission to be restyled by AI. You must not submit photos of children, of public figures you do not have permission to depict, or of anyone who has not consented. You must not use the App to create sexual, harassing, defamatory, deceptive, or otherwise unlawful imagery, to impersonate anyone, or to disrupt or gain unauthorized access to our systems. We may refuse or block generations that our providers' safety systems reject, and may terminate accounts used to abuse the service.

7. Intellectual property

The App, its content and trademarks are owned by samko labs, s. r. o. or its licensors. You retain ownership of the photos you submit. As between you and us, you own the images the App generates from your photos and may use them personally or commercially, subject to these Terms and to the terms of our image provider. We claim no license to your photos or generated images beyond what is technically necessary to produce the image you asked for.

8. Disclaimers & limitation of liability

The App is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, samko labs, s. r. o. is not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable Slovak or EU law, including your statutory consumer rights.

9. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App at any time.

10. Governing law

These Terms are governed by the laws of the Slovak Republic, without prejudice to the mandatory consumer-protection rules of your country of residence. Disputes are subject to the competent courts of the Slovak Republic. EU consumers may also use the European Commission's Online Dispute Resolution platform.

11. Apple as third-party beneficiary

These Terms are between you and samko labs, s. r. o. only, not with Apple. Apple has no obligation to furnish support or maintenance for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes

We may update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
